PRACTICE POLICIES AND PATIENT CONSENT

1. Practice Overview

Domilien Psychiatry and Wellness provides outpatient psychiatric evaluation, medication management, and psychotherapy for adults and adolescents. Services are offered in-person and via telehealth to patients physically located in Florida at the time of care. A provider-patient relationship begins only after an initial evaluation, discussion of risks and benefits, and signed consent and not by website inquiry or email alone.

2. Appointments, Cancellations, and Fees

  • Scheduling: Appointments are by scheduled time only. Please arrive 10 minutes early for check-in.
  • Cancellation: We require 48-hour notice. Late cancellations or no-shows may incur the full session fee, not billable to insurance.
  • Payment: Co-pays, deductibles, and self-pay fees are due at the time of service. We will submit claims to contracted insurers, but you are responsible for verifying benefits.
  • Records requests: Copies are provided per Florida law. We charge only the actual cost of copying as permitted by §456.057.

3. Privacy Policy – HIPAA Notice of Privacy Practices

Your privacy is a priority. We protect Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA) and Florida law. HIPAA Telehealth Information

  • Personal Identifiers: name, date of birth, phone, email, address, insurance ID
  • Health Information: psychiatric history, medications, treatment notes, labs
  • Technical Data: IP address, browser type, portal usage logs
How We Use Your Information:
  • Provide diagnosis, treatment, and care coordination
  • Schedule, remind, and bill for services
  • Comply with legal, safety, and quality requirements
  • Improve website function (de-identified analytics only)
Protection:
We use encrypted EHR, secure telehealth platforms, and staff training. All record owners must implement policies to protect confidentiality and security of medical records.
Your Rights Under HIPAA and Florida Law (§456.057):
  • Request access to and copies of your records. For psychiatric records, we may provide a summary report first; upon written request, complete copies go directly to a subsequent treating psychiatrist.
  • Request amendments, restrictions, and an accounting of disclosures.
  • Choose confidential communications.
  • Receive breach notification under the Florida Information Protection Act (FIPA §501.171) within 30 days.
We will not use PHI for marketing without written authorization, and we never sell data.

4. Confidentiality Limits (Florida)

Information is confidential except when law requires or permits disclosure:
  • Imminent risk of harm to self or others, abuse of child or vulnerable adult, or court order
  • Coordination with other treating providers involved in your care with your written authorization
  • As needed for billing, or in medical negligence proceedings

5. Telehealth Policy – Florida §456.47

Telehealth means synchronous or asynchronous care via secure telecommunications, not including email or fax. By consenting to telehealth, you understand:
  • You must be physically located in Florida during the visit. Venue for care is deemed where you are located.
  • The provider will practice to the same standard as in-person care, document services in your medical record, and maintain confidentiality.
  • Risks include technology failures, interruptions, and limited physical exam. Benefits include access and continuity.
  • Controlled substances: Florida permits telehealth prescribing for psychiatric disorders under §456.47, but Schedule II stimulants require an appropriate evaluation and follow federal Ryan Haight rules.
  • You may decline telehealth at any time and request in-person care when available.

6. Communication Consent (Email & SMS Opt-In)

By providing your mobile number and email, you may opt in to receive:
  • Appointment reminders and scheduling updates
  • Billing notifications and portal alerts
  • Practice announcements
Important:
  • Email and SMS are not fully secure. We will not discuss detailed clinical information by text unless you request it in writing.
  • You may opt out anytime by replying STOP or notifying the office.
  • Standard message rates apply.
  • Submitting information through website forms does not create a provider-patient relationship and should not include sensitive medical details.

7. Medical Records Retention and Closure

  • We retain records for at least five years from your last contact, as required by Florida Board of Medicine Rule 64B8-10.002.
  • For minors, records are kept at least five years and until two years after age 18 per community standard.
  • If the practice closes, relocates, or retires, we will publish notice for four consecutive weeks, notify the Board, and offer you a copy of your record per §456.057.
